Requalify Acceptable Use Policy

This Acceptable Use Policy (the "AUP") describes prohibited uses of the Requalify cloud platform, websites, and related services (the "Service") provided by Requalify, LLC ("Requalify," "we," "us").
This AUP is incorporated into the Requalify Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service. A violation of this AUP is a material breach of the Terms of Service.
You are responsible for your own conduct and for the conduct of anyone using the Service through your account, including your Authorized Users.
1. Who This Applies To
This AUP applies to:
- Customers and prospective customers who use the Service;
- Authorized Users who access the Service on a customer's behalf (including employees, contractors, and inspectors);
- Trial users and visitors; and
- Anyone else who accesses the Service or the websites at https://requalify.io and https://requalify.app.
2. Prohibited Content
You may not use the Service to upload, store, transmit, or share content that:
- Is unlawful, defamatory, harassing, or threatening;
- Infringes any copyright, trademark, trade secret, patent, publicity, or privacy right;
- Is obscene, child-exploitative, or promotes violence or discrimination;
- Contains protected health information, sensitive financial information (such as full payment card numbers or Social Security numbers), or other sensitive data types that are not required to use the Service, unless a written arrangement with Requalify expressly permits it;
- Contains viruses, malware, ransomware, trojans, worms, or other malicious code;
- Impersonates another person or entity, or falsely states or misrepresents your affiliation with a person or entity; or
- Violates any applicable law or regulation (including, for customers performing regulated activities, 49 CFR Parts 171–180, OSHA standards, or similar rules).
3. Prohibited Activities
You may not, and may not permit any third party to:
3.1 Abuse the Service
- Attempt to gain unauthorized access to the Service, other customers' accounts, or any network, system, or data connected to the Service;
- Interfere with or disrupt the integrity, performance, or availability of the Service (for example, by launching a denial-of-service attack, flooding, or any other volumetric abuse);
- Probe, scan, or test the vulnerability of the Service or any related system, or evade or circumvent security mechanisms, access controls, rate limits, or usage quotas, without Requalify's prior written authorization; or
- Perform any penetration test, security assessment, red-team exercise, or load test against the Service without our prior written authorization. See Section 7 on Responsible Disclosure.
3.2 Reverse Engineering and Derivative Use
- Copy, modify, adapt, translate, or create derivative works of the Service, its user interfaces, or the Documentation, except as expressly authorized in the Terms of Service;
- Reverse engineer, disassemble, or decompile the Service, or attempt to discover the source code, algorithms, data structures, or underlying ideas, except to the extent expressly permitted by applicable law notwithstanding this prohibition;
- Remove, alter, or obscure any copyright, trademark, or other proprietary notice or legend; or
- Access or use the Service to build a product or service that competes with the Service, or for benchmarking or competitive analysis, without Requalify's prior written consent.
3.3 Scraping and Automation
- Use any automated means (bot, spider, crawler, scraper, or similar program) to access, collect, or extract data from the Service, except through Requalify's documented APIs and subject to their documented rate limits and terms;
- Bypass robots.txt, rate limits, CAPTCHA, or similar mechanisms;
- Extract large amounts of Customer Data, Service data, or metadata that are not your own and for which you do not have a legitimate business need; or
- Resell, redistribute, or mirror the Service or content from the Service.
3.4 Resale and Sharing
- Rent, lease, sell, sublicense, time-share, or otherwise make the Service available to any third party except as expressly authorized;
- Share Authorized User credentials between individuals, or create accounts through automated means or under false identities; or
- Provide the Service, in whole or part, to any third party as a managed service, hosted service, or outsourced service, without a written reseller or partner agreement with Requalify.
3.5 Interference with Other Users
- Collect or harvest information about other users of the Service without their consent;
- Send unsolicited commercial messages ("spam") through the Service;
- Impersonate other users, deceive other users, or take actions that would reasonably be expected to harm other users; or
- Upload content or take actions that are likely to cause Requalify to violate any law or to be held liable to a third party.
3.6 Illegal or High-Risk Uses
- Use the Service in a manner that violates applicable law or regulation, including (without limitation) hazardous-materials transportation rules, export-control and sanctions rules, anti-bribery rules, and consumer-protection rules;
- Use the Service to support any activity prohibited by U.S. sanctions (see Terms of Service § 19.1);
- Use the Service in any life-critical application where a failure could reasonably be expected to result in death, personal injury, or severe environmental or property damage, as the sole control for such a use (the Service is a recordkeeping and workflow tool and is not designed as a failsafe control);
- Use the Service in connection with the operation of nuclear facilities, flight navigation or communication systems, or weapons systems; or
- Use the Service to produce, market, or distribute any of the business categories listed as prohibited in the then-current Stripe Restricted Businesses list (to the extent relevant to the Service's billing integration).
3.7 No Competing Products
- Use the Service to develop, test, or train a product or service that competes with the Service; or
- Use benchmarks, test results, or performance data about the Service in any public comparison, marketing, or publication, without Requalify's prior written consent.
4. Stricter Rules for Authorized Users Performing Inspections
The Service enables customers to record regulated activities. You are responsible for the accuracy and integrity of the records you create. In particular, you may not:
- Falsify, backdate, or alter inspection records, test pressures, expansion measurements, calibration data, or any other entries required or permitted by 49 CFR §§ 180.205–180.217 or similar regulations;
- Reuse or clone inspector credentials to create records that attribute your actions to another person;
- Mark cylinders or issue reports based on data entered by someone other than a qualified inspector; or
- Submit a Requalifier Identification Number (RIN) or other regulatory identifier that you do not have the right to use.
Requalify is a recordkeeping tool and is not responsible for verifying the accuracy of inspection entries. Falsification of regulated records can expose you and your employer to civil and criminal liability.
5. Customer Responsibility for Authorized Users
Customers are responsible for ensuring that their Authorized Users comply with this AUP. Customers will:
- Train Authorized Users on appropriate use of the Service;
- Promptly disable accounts for departed personnel or anyone whose use does not comply with this AUP;
- Monitor Authorized User activity to the extent appropriate for the customer's business; and
- Report to Requalify any known or suspected abuse of the Service by Authorized Users or third parties.
6. Enforcement
6.1 Our Rights
Requalify may investigate suspected violations of this AUP at any time. We may, without prior notice where prompt action is reasonably warranted, suspend or restrict access to the Service, remove or disable content, require that prohibited content or conduct be cured, or terminate the Subscription for a material or repeated violation. Our rights under this AUP are in addition to any other rights and remedies under the Terms of Service or applicable law.
6.2 Where Possible, Notice and Cure
Where the violation is not critical and time allows, we will aim to give the customer notice and a reasonable opportunity to cure before suspending or terminating access.
6.3 No Obligation to Monitor
Requalify is not required to monitor customer use of the Service, but we may do so for security, legal, and service-quality purposes.
7. Responsible Disclosure of Security Issues
We welcome good-faith security research. If you believe you have found a security vulnerability in the Service:
- Please email [email protected] promptly with a detailed description and, where applicable, steps to reproduce;
- Do not publicly disclose the vulnerability until we have had a reasonable opportunity (typically 90 days) to investigate and remediate;
- Do not exploit the vulnerability beyond the minimum necessary to demonstrate its existence;
- Do not access, modify, or destroy Customer Data belonging to others;
- Do not conduct denial-of-service testing or other disruptive testing; and
- Do not use social engineering against Requalify personnel.
Good-faith research that complies with these guidelines is considered authorized for purposes of this AUP and the Terms of Service, and Requalify will not pursue legal action against researchers who meet these guidelines. We do not currently operate a paid bug-bounty program but will consider recognition on request.
8. Reporting Abuse
If you believe a customer, Authorized User, or other party is using the Service in violation of this AUP — for example, by sending spam, storing unlawful content, conducting an attack against another system, or falsifying regulated records — please report it to [email protected]. Please include enough information (URLs, email addresses, IP addresses, time stamps, and descriptions) for us to investigate.
9. Changes to This AUP
We may update this AUP from time to time. Material changes will be announced at least thirty (30) days before they take effect, by email or in-Service notice. Non-material changes (clarifications, typographical corrections) take effect on posting. The "Last Updated" date at the top of this AUP shows when it was last revised.
